Montana's medical marijuana program was established through Initiative 148 in 2004 and has been through significant legislative changes over the years. With recreational cannabis legalized through Initiative I-190 in 2020 and sales starting in January 2022, the medical program remains valuable due to the significant tax differential between medical and recreational purchases.

The tax savings for medical patients in Montana are among the most compelling in the country. Recreational cannabis is subject to a 20 percent excise tax, while medical purchases are exempt from this tax. For regular consumers, this exemption easily justifies the $25 annual registration fee many times over, making the medical card an economically sound investment for qualifying patients.

Medical patients also retain the right to cultivate up to 2 mature plants and 2 seedlings per person for personal medical use at their private residence, providing an additional pathway to affordable access.
